Terms of Use
The rules for using the WILDSUITS app and this website, written to be read.
In short
- You get a personal licence to use WILDSUITS on your own Apple devices.
- What you enter in the app belongs to you and stays on your device.
- Recommendations are general guidance, not safety advice. You decide whether and how to go in the water.
- Apple’s standard licence agreement applies. French law governs these terms.
1. About these terms
These Terms of Use (“Terms”) apply to the WILDSUITS iOS app (the “App”) and the website wildsuits.net, provided by WILDSUITS, 23 Rue de Bel-Air, 44680 Sainte-Pazanne, France (“WILDSUITS”, “we”, “us”). By downloading or using the App you agree to these Terms. If you do not agree, please do not use the App.
2. Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own non-commercial purposes on Apple devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
You may not copy, modify, distribute, sell, rent or sublicense the App, reverse engineer it except where the law allows, or use it in a way that breaks the law or the rights of others. The App, its design, text, graphics and software remain the property of WILDSUITS or its licensors.
3. Your content
The gear, sessions, notes, checklist and care marks and thermal comfort notes you enter (“Your Content”) belong to you. Your Content is stored only on your device; we do not receive it and claim no rights over it. You are responsible for keeping your device and any backups. See our Privacy Policy for details.
4. Recommendations are not safety advice
WILDSUITS offers general guidance about gear, checklists and wetsuit care, based on the information you enter. It is not safety advice and is not a substitute for your own judgement, training, local knowledge or professional instruction.
Water and weather conditions change quickly and can be dangerous. Always check local conditions and forecasts, follow lifeguards, signage and local rules, know your limits, and never go in the water because the App suggested a kit. You alone decide whether, where and how to take part in any water activity.
5. The App is provided “as is”
We work to make WILDSUITS useful and reliable, but the App is provided “as is” and “as available”. To the extent permitted by law, we make no warranty that it will be error-free, uninterrupted, or that its suggestions will suit your particular situation. This does not affect the legal guarantees you have as a consumer.
6. Limitation of liability
To the extent permitted by applicable law, WILDSUITS is not liable for any decision you take in the water or in any weather or sea conditions, or for any loss, injury or damage arising from your use of the App’s suggestions, checklists or care tips, including damage to equipment.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under French law, including liability for death or personal injury caused by our fault, for gross negligence or wilful misconduct, or your statutory rights as a consumer.
7. Apple and the App Store
The App is licensed to you under Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These Terms supplement the Standard EULA; if they conflict, the Standard EULA prevails to the extent of the conflict.
These Terms are between you and WILDSUITS, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support for it, and is not responsible for handling any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
8. Changes and availability
We may update the App and these Terms from time to time. If we make significant changes to the Terms, we will update the “Last updated” date above. Continuing to use the App after a change means you accept the updated Terms. You may stop using the App at any time by deleting it.
9. Governing law
These Terms are governed by French law. If you are a consumer, you keep the protection of the mandatory rules of the country where you live. Before going to court, please contact us so we can try to resolve the issue amicably. Any dispute that cannot be resolved amicably will be brought before the competent French courts, subject to any mandatory rules giving consumers the right to go to the courts of their place of residence.
